A Florida woman, Melissa Payne, who fatally sh%t 62-year-old Bart DiGuglielmo during a confrontation over a parking space at a Walmart in North Lauderdale, will not face charges, prosecutors have announced.
According to the Broward County State Attorney’s Office, Payne was protected by Florida’s stand your ground law after evidence showed she acted in self defense during the June 30, 2026 incident.
The confrontation reportedly began after Payne and DiGuglielmo attempted to park in the same space. Prosecutors said DiGuglielmo later returned to his vehicle and allegedly threatened to mess her car up before driving away, parking and walking toward Payne’s vehicle.
A witness said DiGuglielmo appeared visibly angry as he approached Payne, who had reportedly stepped out of her car holding a phone and a f+rearm.
According to the memo, Payne warned him If you keep coming up to me, “I’m going to sh%%t you!”
Despite the warning, prosecutors said DiGuglielmo continued approaching her. Video evidence reportedly showed him aggressively approach Payne as she backed away, with him allegedly motioned as if he was going to d@mage her vehicle with his keys.
He eventually turned back before approaching her again, at which point Payne f+red, striking him in the abdomen.
Payne then called her husband and reportedly said, “Bae, I sh%t. Call the cops.”
Prosecutors said the entire confrontation was captured by multiple cameras, including cellphone and Tesla footage, and Payne’s account was consistent with the available videos.
Broward prosecutors concluded that Payne was legally entitled to be in the Walmart parking lot and had a right to possess a f+rearm.
“Accordingly, she had the right to stand her ground if she was in reasonable fear of de@th or great bodily h@rm,”the prosecutor said
They added that she did not have to wait to be att@cked before resorting to de@dly force and did not have to retreat as long as her fear was reasonable.
